Information on marriage in Bali for U.S Citizens from Consular Agency of the United States of AmericanThe validity of a marriage is governed by the law of the place where it is performanced. A marriage performed in Indonesia which is legally according to Indonesia law is legally valid in the United States. Once you and your fiance(e) have made the decision yo get married once you and your fiance(e) have made decision to get married in Indonesia, you must first determine the type of religious ceremony that you intend to have, in accordance with law No. 1 of 1974 concerning marriage in Indonesia ( Article 2 (10 : " A marriage is legitimate if it has been performed according to the laws of the respective religious and beliefs of the parties concerned". A marriage under Islam is solemnized by the Office of Religious Affairs ( Kantor Urusan Agama ). The Islamic marriage Certificates (Buku Nikah issued by the office are legally valid and do not require recordation with any other agency. A Christian, Hindu, or Buddhist marriage is solemnized first in church or Temple ceremony, after which the marriage must be recorded is not legal. There is Civil Registry Office ( kantor Catatan Sipil in each of the eight regency district (kabupaten. The Republic Indonesia requires foreign citizen to file with the Civil Registry Office in the regency where they are staying a Notice of Intention to marry as well as letter of No Impediment obtained from their consular representative. The Civil Registry Office has a mandatory waiting period of ten working day from the date of filling. Letter of No Impediment to Marriage :

Never married : Letter "Surat Keterangan Belum Kawin" from Kepala Desa or Lurah (mayor). Men age 18 - 21 and women 16 - 21 : parental letter of consent , signed on meterei/tax stamp Rp. 2000. Before the marriage you and your fiance(e) also may wish to file with the Civil Registry Office a prenuptial contract regarding property tenancy (Surat Pernyataan Harta ), which must be signed before an Indonesia Notary Public. This contract is necessary if you wish to hold property separately during the marriage. In the absence of such a document, Indonesian marriage Law assumes joint ownership of property. Two witnesses over age 18 are required. They must show the originals and present photocopies of their passport is foreign citizen or KTP (residency) cards is Indonesian citizen. Civil registry employees can act as witnesses. Recordation by Civil Registry officials can also be performed directly at the religious ceremony for additional fee. The marriage certificate will be issued by the Civil Registry usually on the same or next day. It is not necessary for a marriage certificate to be registered or notarized by the Consular Agency. You may need an English translation of the marriage certificate in the future, for example when applying for reports of birth for children born abroad or for visas to the U.S for alien spouse and children.
